Another round of NASCOURT is underway.
AM Racing, a team that formerly fielded entries in the NASCAR O’Reilly Auto Parts Series and NASCAR Craftsman Truck Series, is suing Sigma Performance Services, according to public court documents from Iredell County’s General Court of Justice Superior Court Division.
According to AM Racing’s complaint, SPS is illegally in possession of assets that belong to AM Racing, and those items include intellectual property of the AM Racing team.
Last October, SPS agreed to purchase the AM Racing team, which fielded a NASCAR O’Reilly Auto Parts Series team at the time. After publicly announcing the sales agreement, AM Racing officially called off the attempted acquisition by SPS in January 2026.
AM Racing’s claim continues to state that SPS is holding onto several assets that belong to, and are not easily replaceable by, the organization. Among the assets that AM Racing claims SPS is holding onto are a superspeedway chassis, two intermediate chassis, an ARCA engine, and an ARCA Garage Box.
AM Racing values the assets illegally in SPS’ possession at $320,000, and states SPS has impermissibly utilized AM Racing’s intellectual property, which it gained access to during the “Due Diligence Period” of the attempted acquisition. AM Racing values the intellectual property at $350,000.
AM Racing has asked the court for injunctive relief from a judge to get its physical and intellectual property back, despite the initial agreement with SPS stating an arbitrator being needed to settle all disputes.
“The provisional remedy is needed as the matter is urgent,” AM Racing said in the court filing. “The property is utilized in stock car racing, and collisions are common in the stock car racing business. A collision could damage or destroy the property. The Plaintiff stands to suffer serious irreparable harm if the injunctions are not issued in that the special and unique character of the property means that if it is sold, damaged, or destroyed, it cannot be replaced by the Plaintiff.”
According to the filing, AM Racing would like Sigma Performance Services to return the property and do so without utilizing or selling the physical or intellectual property or altering it in any way.
