The highs and lows of the last month have been brutal for Jeremy Clements Racing after the team was assessed an L2 Penalty just days after scoring an upset victory in the NASCAR Xfinity Series race at Daytona.
However, on Tuesday, the rollercoaster of emotions continued, as the National Motorsports Appeals Panel heard and decided on the team’s appeal to NASCAR’s original penalty, which stripped the team of a guaranteed spot in the Playoffs.
The original penalty, which NASCAR cited as a violation of Section 14.6.12.K&U Intake Manifold, included a $60,000 fine to crew chief Mark Setzer, the loss of 75 championship driver and owner points, as well as the loss of 10 Playoff points.
Upon hearing Jeremy Clements Racing’s testimony, the panel elected to rescind the penalties originally assessed by the sanctioning body, as it was believed that the organization didn’t violate the rule specified in the Penalty Notice.
“Our small, family-owned team works hard to bring a safe, legal and competitive car to the racetrack every week and are pleased that the previous ruling was overturned,” a statement from the team reads. “We remain focused on competing for the 2022 NASCAR Xfinity Series championship and appreciate the continued support of our fans and sponsors.”

With the penalty overturned, Jeremy Clements will now have his Daytona victory counted towards his eligibility into the 2022 NASCAR Xfinity Series Playoffs. With 75 points being restored, Clements is locked into the top-20 in Driver Standings.
When it comes to the series Owner’s Playoffs, the points restoration brings him to 20th-place in series Owner Point Standings, only nine points ahead of the DGM Racing No. 36, and 20 points ahead of the SS Green Light Racing No. 07.
