LEGACY MOTOR CLUB motion for Preliminary Injunction denied in lawsuit against Rick Ware Racing

On Wednesday, a North Carolina judge officially denied LEGACY MOTOR CLUB’s motion for a preliminary injunction against Rick Ware Racing. The motion is tied to a lawsuit between the two teams in regard to a sale agreement for one of Rick Ware Racing’s NASCAR Cup Series Team Charters.

Wednesday’s ruling will now allow Rick Ware Racing to lease or sell the Charter in question despite the lawsuit playing out in the background.

A temporary restraining order granted to LEGACY MOTOR CLUB on April 9, forced Rick Ware Racing to make no moves with the Charter in the alleged sale agreement with LMC until the ruling was made in the motion for Preliminary Injunction.

Following Wednesday’s ruling, Rick Ware, the team owner of Rick Ware Racing, issued a statement saying, “RWR is gratified by the Court’s decision in this case. It’s good to be vindicated.”

LEGACY MOTOR CLUB filed the initial complaint in the court on April 2, alleging that Rick Ware Racing had pulled out of a legally binding agreement to sell one of its NASCAR Cup Series team Charters to LEGACY MOTOR CLUB.

The initial complaint was highly redacted, but LMC stated that the contract had been signed by both parties, and had been initialed by all on each page as well. LEGACY MOTOR CLUB alleged in the complaint that Rick Ware Racing then attempted to pull out of the deal.

In 2025, Rick Ware Racing has fielded the No. 51 entry in the NASCAR Cup Series full-time with one of its team Charters, and has also fielded the part-time No. 01 entry for Corey LaJoie. The team’s second Charter is currently being leased to RFK Racing this season.

LEGACY MOTOR CLUB has two full-time Chartered teams in 2025, the No. 42 entry driven by John Hunter Nemechek, and the No. 43 driven by Erik Jones. The team has had a part-time No. 84 entry, which has been driven by team co-owner Jimmie Johnson. LEGACY MOTOR CLUB is looking to have three Chartered entries in 2025.
